James Biela is back in court. The man convicted of the kidnapping, rape and murder of 19 year old Briana Dennison claims he did not receive competent counsel during his first trial, and wants a new one. His former lawyer, who was then a public defender testified about a change of venue that was sought but denied, despite massive pre trial publicity. Maisie Pusich also complained about three jurors she didn’t consider qualified to sit at trial, because they admitted they would consider no punishment other than the death penalty if Biela was convicted. The appeal hearing is expected to last for several days.
