Supreme Court to Hear ESA Arguments

The Nevada Supreme Court will hear oral arguments Friday about whether Judge Eric Johnson wrongly decided to dismiss the ACLU’s “Duncan vs. Nevada” lawsuit over the school voucher program. The ACLU of Nevada appealed Judge Johnson’s decision in June, they say he did not use the appropriate legal standard in dismissing the lawsuit, and wrongly interpreted Nevada’s constitution. If the appeal is successful, the case will move forward and be heard on its merits.  ACLU argues the voucher program violates the Nevada Constitution by allowing taxpayer public funds to be used to fund religious education. Supporters consider it similar to a tax rebate, and say parents, not the state choose where to spend it.
