Pot Dispute Will Be Decided by Nevada Supreme Court

The dispute over whether alcohol distributors should have the exclusive right to distribute legal marijuana is headed for the state supreme court. The state’s highest court rejected an injunction sought by the independent liquor distributors, but also rejected a motion by the Nevada Tax Division to dismiss the case. The court has set oral arguments on the dispute for October 3rd. The voter approved initiative gave alcohol distributors exclusive distribution rights for 18 months, but the Tax Division said none were ready to go at the start of recreational sales, and opened up licensing to others, citing an emergency shortage of product at dispensaries.
