A Las Vegas judge wants more information before he decides the lawsuit against Nevada’s ESA school choice program. Judge Eric Johnson is asking lawyers to weigh in on what facts are still needed before he rules on a motion to dismiss, or for summary judgment. That information is due March 11. Nevada’s Education Savings Account program allows parents to claim part of their child’s “per-pupil” state education funds and use it for private schools. The state says parents direct the funds. ACLU lawyers say it violates the Nevada Constitution’s ban on using public funds for sectarian purposes.
